How can a client know that the information provided by FMI isn't something that they already know ?

The reality is that we don’t know exactly how much each client knows, hence there is no way that we can say if the information that we will provide in the booklet is entirely old or new to them. However, it is important to mention that we gather all of the information in the booklet from reputable International and local research information centres; and not from rumors and hearsay that are circulate amongst people. We have a professional and systematic approach in offering unique solutions to our clients problems therefore we believe registering with FMI is invaluable.

How long does it take for FMI to prepare the 3+ Market Report ?

It takes on average 1 month to 45 days to prepare the report, depending on the complexity of the case.

Is FMI a Developer or Real Estate company?

No, FMI is neither. We are a Real Estate Consultancy company, we are focused primarily on providing consultancy to investors with on-hold investment.

Is there a difference between people who bought off-plan properties in Dubai and those in Ajman? Are their options the same ?

No, there is no difference between investors in the two locations. Our procedure is the same for everybody regardless of the location of their investment with all provided with the option for Settlement, Litigation and Asset Relocation.

What is Mediation ?

Mediation is a Dispute Resolution Process. When two parties are unable to settle a dispute, they will often use mediation in order to reach an agreement. When two parties agree to use mediation, a neutral third party will work with both parties in dispute to assists and find a lasting win-win solution to their conflict.

As of today there are 742 registered Developers (in Dubai) and the majority of them have multiple projects in all Emirates.

What is FMI's role in settlement?

FMI will provide in the 3+ Market Report detailed information about the status of your project, then if you wish to contest with your developer we will provide consultancy services to find the best settlement and list of mediators to conduct the settlement .

How much it will cost me if I require FMI's help with a settlement?

There is 2 series of payment:

  1. A per hour consultancy fee is paid and per meeting for mediators (dependant on the value of the case) till settlement happens.
  2. A success fee is paid that is a reflection of the total value of the outcome and percentage of discount achieved.

What information do FMI provide in Real Estate Litigation?

  1. Legal status of the project and developer in court and with the land department.
  2. Update of the cases that have been brought against your project.
  3. List of law firms with extensive experience and knowledge of your project.

Which lawyers or advocate offices do FMI work with?

We figuratively work with all major law firms in UAE. Depending on your case we propose to you the most successful corresponding (related to client’s case) ones in your field with the highest rate of success. We do not advise to go to a particular lawyer, we will tell you which lawyers have already had successful cases with your project.

How are lawyers with experience with my project more helpful for me?

  1. Firstly they are aware of the strengths and weaknesses of the developer in question and they have had previous success in winning similar cases against developer, therefore there is a better chance of making a settlement before a court case.
  2. Secondly because of their experience and knowledge of legal documents signed by clients, developers, and updates on the legal status of the project with cases won to date. There is no need therefore to review the complete case which is time and cost consuming.

Is there any possibility that some law firms won cases or opened case and FMI do not have access to them?

Yes it is possible but unlikely. This would only occur if they had not listed their case with us.

What is the cost of the information ?

It’s completely free of charge as soon you are registered with us. If after the 3+ Market Report is completed you make the decision to enter into legal action through the court we will provide you with a list of lawyers depending on your project and arrange a meeting with them.

What will be the terms of payment to the law firm?

It all depends on which law firm you select but generally there are two terms of payment:

  1. Fees paid for services during the case
  2. Success Fee ( not including court fee, translation and PRO).

Is Asset Relocation, Exchange or Swapping legal ? Does the Land department know about this activity ?

The service that FMI provides is Asset Relocation. What this means is that a Developer is agreeing to accept all the benefit and liabilities of the on-hold project and the client accepts the benefit and liabilities of a new completed project. It is a mutual agreement between two parties.

To date there has been over $1.3 Billion of property exchanges in the UAE market since the market crash in 2008.

If FMI offer Asset Relocation how do I know if the cost is market competitive? Are they higher than current market price?

Our concern is to find a developer that will accept our clients credit.

We also provide the 3+ Market Report which makes it easy for the client to make an informed rational decision.

How many options are provided for Asset Relocation and what if I don't like what you have proposed ?

If the client is not entirely satisfied with the Asset Relocation offers in time we will offer  them alternative options. We are able to do this as we are constantly adding new Developers and have new inventories.

What is the benefit to the new developer who is accepting the property exchange ?

Very simple, they are in the same position. The Developer who accepts the credits can choose one of the 3 directions.

The new developer will have a bulk number of units. The developer by collecting a large number of different clients will have more financial power to make decisions for each direction.

The difference is that he is in the same line of business, and he could potentially wait for 10 years until for the plot is handed over. But an individual is not usually capable of doing it. plus new developer could be JV with old developer
